How a Helper Can Terminate
Under the Employment Ordinance (Cap. 57), either party can end the Standard Employment Contract by:
- Giving one month's written notice, or
- Paying one month's wages in lieu of notice
In practice, most helpers give notice rather than pay in lieu (since one month's salary is significant for them).
What Happens Next
Once notice is given:
- The helper works out the notice period (or the employer pays/receives wages in lieu)
- The employer must pay all outstanding wages, untaken annual leave, and the return airfare
- The helper's visa becomes invalid and the two-week rule applies — she must leave Hong Kong within 14 days of the contract ending, or before her visa expires, whichever is sooner
Termination vs Absconding
Important distinction:
- Termination: The helper follows the proper process (notice/payment in lieu). This is lawful.
- Absconding: The helper leaves without notice and disappears. This is a breach of contract and potentially a visa violation.
If your helper absconds, file a report with the Police and notify the Immigration Department.
